What If the Archaeological Condition Is Already Overdue?
If development has started and a pre-commencement archaeological condition has not been discharged, this needs handling immediately and carefully, not quietly.
The honest answer
A breached pre-commencement condition is a planning matter with potential consequences for enforcement, for future discharge and for the saleability and financing of the scheme. The scale of the problem depends heavily on how much ground disturbance has occurred and whether anything of significance has been affected.
The practical route is usually to establish what disturbance has taken place, record what survives, and put a scheme to the authority that demonstrates the archaeological interest can still be properly addressed. Approaching the authority with a reasoned proposal is a substantially better position than being approached by it.
